Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Kordial’s website and AI receptionist service (“Service”), operated by Kordial (“we,” “us”). By creating an account or using the Service, you agree to these Terms. If you are using the Service on behalf of a business, you represent that you have authority to bind that business.
1. The Service
Kordial provides a suite of tools for local businesses, currently including:
- Voice receptionist — an AI that answers inbound phone calls on behalf of your business 24/7, captures caller leads, and responds to questions drawn from your website and Google reviews
- Review intelligence — automated analysis of your Google reviews surfacing praise themes, complaint patterns, and staff mentions, delivered as a weekly digest and used to keep your receptionist current
- Business page — a public-facing profile page generated from your scraped website data, reviews, services, and photos, hosted on kordial.ai
We may add or remove features over time. Material changes to what the Service does will be communicated via email to account holders.
The Service is designed to assist your business, not replace human judgment. The AI may make mistakes. You remain responsible for the accuracy of information provided to callers, for following up with leads, and for complying with all applicable laws related to your business and its communications.
2. Eligibility
You must be at least 18 years old to create an account. The Service is available to businesses operating in jurisdictions where Kordial operates. We may refuse service to anyone for any reason at any time.
3. Account
You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. Notify us immediately at support@kordial.ai if you believe your account has been compromised.
4. Call recording and caller consent
The Service records and transcribes calls handled by your Kordial receptionist. Many jurisdictions require that callers be informed of recording. We play a disclosure at the start of every call. However:
- You are responsible for ensuring that your use of the Service complies with all applicable call recording, wiretapping, and consent laws in your jurisdiction and the jurisdictions of your callers
- If your jurisdiction requires two-party or all-party consent, you must not use Kordial for inbound calls without ensuring the disclosure is heard and consent is obtained
- We are not liable for your failure to comply with call recording laws
5. Acceptable use
You agree not to use the Service to:
- Impersonate another business or person without authorization
- Provide false or misleading information to callers
- Make outbound marketing or robocalls (the Service handles inbound calls only)
- Collect data from callers in violation of applicable privacy laws
- Circumvent usage limits or access controls
- Resell or sublicense access to the Service without written permission
- Use the Service for any unlawful purpose or in violation of any regulation
We may suspend or terminate accounts that violate these terms without notice.
6. Plans, billing, and free trial
Kordial offers a free tier and paid subscription plans billed monthly or annually. Paid features are unlocked immediately on subscription. All paid plans include a 14-day free trial; you will not be charged until the trial ends. You may cancel before the trial ends at no charge.
Subscriptions renew automatically. You may cancel at any time from your dashboard; cancellation takes effect at the end of the current billing period. We do not offer partial-month refunds except where required by law or at our sole discretion for billing errors.
We may change pricing with 30 days’ notice to your account email. If you cancel before the change takes effect, you will not be charged the new rate.
7. Founding member pricing
Founding member pricing is locked for accounts created before the applicable cutoff date and maintained in good standing (active subscription, no payment failures). Founding pricing does not transfer to new accounts and is forfeited if your account is cancelled and reactivated.
8. Phone numbers
Phone numbers provisioned through Kordial are leased from our telephony provider and assigned to your account for use with the Service. Numbers are not portable to other providers. If you cancel your account, provisioned numbers are released and may be reassigned.
You may use your own number (BYON) on eligible plans. You are responsible for ensuring your number complies with carrier and regulatory requirements.
9. AI accuracy and limitations
The AI receptionist provides responses based on information scraped from your website and Google Business Profile at setup time. It may:
- Provide outdated information if your business details have changed since the last sync
- Decline to answer questions outside the scope of your scraped content
- Make occasional errors in understanding caller intent or providing accurate answers
You are responsible for reviewing your receptionist’s responses and updating your business information when it changes. We sync your data approximately weekly, and you may trigger a manual sync from your dashboard.
10. Intellectual property
You retain ownership of your business content (website copy, reviews, data you provide). You grant us a license to use that content to operate and improve the Service. We retain ownership of the Kordial platform, software, and brand.
11. Confidentiality
Call transcripts and lead data captured through the Service are your business data. We treat this data as confidential and do not share it except as described in our Privacy Policy or as required by law.
12. Disclaimer of warranties
The Service is provided “as is” without warranty of any kind. We do not warrant that the Service will be uninterrupted, error-free, or that AI responses will be accurate, complete, or suitable for your specific business needs. Use of the Service is at your own risk.
13. Limitation of liability
To the maximum extent permitted by law, Kordial’s total liability to you for any claim arising from or related to the Service is limited to the amount you paid us in the 12 months preceding the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost revenue, or loss of data.
14. Indemnification
You agree to indemnify and hold Kordial harmless from any claims, damages, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any law or third-party rights in connection with the Service.
15. Termination
Either party may terminate the agreement at any time. We may suspend or terminate your account immediately if you violate these Terms, fail to pay, or if we are required to do so by law. On termination, your right to use the Service ends and provisioned numbers are released. We will make your call transcripts and lead data available for export for 30 days after termination.
16. Governing law
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Delaware. If you are located in the EU, local consumer protection laws may apply.
17. Changes to these Terms
We may update these Terms. For material changes, we will notify you by email at least 14 days before they take effect. Continued use of the Service after that date constitutes acceptance of the updated Terms.
